1. Agreement to Terms

By accessing and using Lightarch (the "Service"), you agree to be bound by these Terms and Conditions (the "Agreement"). If you do not agree, please do not use this service.

Lightarch ("we", "our", or "us") is an observability platform built on Cloudflare infrastructure for collecting, storing, and querying application traces, logs, and metrics.

2. Use License

Permission is granted to access and use the Service for your internal business purposes. Under this license you may not:

• Modify, copy, or redistribute platform materials
• Use materials for any commercial purpose outside your own organisation
• Attempt to decompile or reverse engineer any software contained in the Service
• Remove any copyright or proprietary notations from materials
• Transfer credentials or mirror materials on any other server
• Sell or facilitate the sale of Lightarch data or credentials
• Use the Service to build a competing observability platform
• Exceed your account's data ingestion or storage quotas as specified in your Service Plan

3. Disclaimer

The Service is provided on an 'as is' basis. Lightarch makes no warranties, expressed or implied, and hereby disclaims all warranties including implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

4. Your Data

4.1 Ownership

• You retain all ownership rights to data you submit to the Service ("Your Data")
• You grant Lightarch a worldwide, royalty-free licence to process, store, and retrieve Your Data solely to provide the Service
• Lightarch will not use Your Data for any purpose other than providing the Service, except as required by law
• Your Data may be processed in multiple geographic regions via Cloudflare's global infrastructure

4.2 Data Retention and Sovereignty

• Hot storage (D1): Your Data is retained for 48 hours in a per-tenant database on Cloudflare edge locations
• Cold storage (R2 + Iceberg): After 48 hours, Your Data is archived to your own R2 bucket in the region of your choice
• Deletion: You may request deletion of Your Data at any time through your account settings
• Upon termination: Hot storage data is deleted within 30 days; cold storage remains in your bucket under your control

5. Limitations of Liability

In no case shall Lightarch, its officers, directors, or representatives be liable for:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or use
• Cost of substitute goods or services
• Business interruption or loss of business opportunity

Your total liability to Lightarch shall not exceed the amount paid by you in the 12 months preceding the claim.

6. Prohibited Conduct

You agree not to:

• Violate any applicable laws or regulations
• Infringe on intellectual property rights
• Submit malicious code or attempt to gain unauthorised access
• Engage in harassment, abuse, or threats
• Send spam or unsolicited communications
• Scrape or systematically extract data from the Service
• Use the Service in any way that could damage, disable, or impair the platform
• Reverse engineer the Service or attempt to discover source code

7. Governing Law and Dispute Resolution

These Terms are governed by the substantive laws of the State of Delaware, United States, without regard to its conflict of law provisions.

Any dispute arising out of or relating to this Agreement shall be subject to binding arbitration administered by the International Chamber of Commerce (ICC) under ICC Arbitration Rules. The seat of arbitration shall be Geneva, Switzerland. The language of the arbitration shall be English.

Compliance: Nothing in this Agreement prevents Lightarch from complying with applicable laws including data localisation requirements and data protection laws (GDPR, CCPA, POPIA, PIPEDA, PDPA, LGPD, and others).

8. Modifications

Lightarch may revise these Terms at any time. Continued use of the Service after changes constitutes acceptance of the new Terms. Material changes will be communicated via email with 30 days' notice where required by applicable law.

9. Entire Agreement

These Terms, together with the Privacy Policy, Data Processing Agreement, Cookie Policy, and Acceptable Use Policy, constitute the entire agreement between you and Lightarch with respect to your use of the Service.
